Legal Basis and Scope

These Terms and Conditions (AGB – Allgemeine Geschäftsbedingungen / CGV – Conditions Générales de Vente) govern the relationship between Coaching Excellence Suisse and any person using or purchasing services from the website CoachingExcellence.ch.They are established in accordance with Swiss Code of Obligations (OR / CO)

Applicable cantonal regulations in the Canton of Jura

By accessing our services, you confirm that you are legally capable of entering into contracts and that you accept these Terms fully.

2. Services Offered:

Coaching Excellence Suisse offers

Personal and professional coaching (NLP, burnout recovery, life strategy)

Communication consulting and workshops

Tailored Swiss wellness retreats (3–5 days, adults only)

Online sessions via secure digital platforms

All coaching services are non-therapeutic and do not substitute medical, psychiatric, or legal advice

In case of clinical needs, clients must consult a licensed healthcare provider.

3. Client Obligations

By using our services, you agree to :

* Provide accurate and truthful personal information

* Participate actively and respectfully in all sessions

* Refrain from defamatory, aggressive, or unlawful behavior

* Ensure personal health is stable enough to participate (especially for retreats)

* Acknowledge that results may vary depending on individual engagement

4. Bookings and Cancellations:

All coaching and retreat sessions must be booked in advance.

Cancellations must be made at least 24 hours before the scheduled session.

Cancellations within 24 hours or no-shows are **fully chargeable** unless force majeure (illness, accident, death).

Retreat bookings follow their own contractual agreement, including cancellation deadlines and refund conditions.

5. Prices and Payments

Prices are in Swiss Francs (CHF)*and include VAT where applicable (Art. 10 ff. LTVA).*

Payment is due before the service is rendered unless otherwise agreed in writing.*

Accepted payment methods: **Stripe (Visa, MasterCard, AMEX)**, bank transfer, TWINT.*

Invoices unpaid after 30 days may incur **reminder fees** and **legal collection procedures.

6. Right of Withdrawal (Swiss Distance Selling Law)*

*According to Swiss contract law, coaching and wellness services provided on a scheduled date are **not subject to withdrawal** once confirmed, especially if the session has started. However, we may offer **goodwill solutions** for rescheduling if timely notice is given.

7. Refund Policy

Coaching sessions** are non-refundable once delivered.**

Unused pre-paid coaching hours may be refunded proportionally, minus a **20 CHF admin fee.

Retreat deposits** are non-refundable unless cancellation is due to force majeure or the retreat is canceled by Coaching Excellence Suisse.

8. **Confidentiality & Data Protection***

We treat all personal data and coaching content with strict confidentiality.*

All data is handled in compliance with the **Federal Act on Data Protection (FADP, 2023 revision)*

Data is never shared without written consent, unless legally obligated (e.g., police, court orders).

You have the right to **access, correct, or delete** *your stored data at any time by contacting us.-

9. Liability Limitation

Coaching Excellence Suisse is not liable for outcomes, decisions, or consequences following the use of our services.*

We are only liable for direct damages caused by gross negligence or proven intentional misconduct (Art. 97 ff. CO).

We decline any liability for indirect, incidental, or consequential damages (e.g. loss of income, emotional distress).

10. **Intellectual Property**

All website content (text, logo, programs, retreat concepts) is the exclusive property of Coaching Excellence Suisse and protected under **Swiss copyright law.

No part may be copied, reproduced, or used commercially without written consent.

11. **Applicable Law and Jurisdiction**

These Terms are governed exclusively by **Swiss law**.* **

Place of jurisdiction: Delémont (Canton Jura)

Applicable law: Swiss Code of Obligations and local regulations of Canton Jura

All disputes shall first attempt amicable resolution. Failing that, legal action may be brought before the competent courts of Jura.-

We reserve the right to modify these Terms at any time. The latest version will always be available on our website. Continued use of the site implies acceptance of updated terms.
